Welcome to 1-OPH. These Terms & Conditions (“Terms”) govern your access to and use of our website, showroom, products, services, and any interactions with us—online or offline.

By accessing our website, placing an order, visiting our studio, submitting designs, or engaging our services, you agree to be bound by these Terms.

1. COMPANY INFORMATION & SCOPE

1-OPH is a brand operated under ALLING VENTURES TRADING LLC, a company registered in Mainland Dubai, United Arab Emirates.

• Business Nature: Art fabrication, sculpture design, custom manufacturing, retail art objects, and installation services
• Markets Served: UAE, GCC, USA, UK, Europe, and global markets

These Terms apply to:

• Website usage
• Store/showroom visits
• Custom and ready-made products
• Design services and concept development
• Fabrication, delivery, and installation
• Digital communications and design sharing

2. ACCEPTANCE OF TERMS

By using our services, you confirm that:

• You are legally capable of entering binding agreements
• You have read and understood these Terms
• You agree to comply with all applicable laws and regulations

If you do not agree, you must not use our services.

3. PRODUCTS & SERVICES

3.1 Nature of Products

1-OPH creates and supplies:

• Custom-made sculptures and installations
• Limited-edition and retail art pieces
• Functional art (fountains, benches, planters, fireplaces, etc.)

Materials may include marble, bronze, stainless steel, fiberglass, and mixed media.

3.2 Artistic Variations

Due to the handcrafted and artistic nature of our work:

• Minor variations in color, texture, grain, finish, patina, or proportion are normal and expected
• Such variations do not constitute defects

4. CUSTOM ORDERS & COMMISSIONED WORKS

4.1 Design Approval

• All custom orders require written approval (email/WhatsApp) before production
• Once approved, designs cannot be altered without additional cost and timeline impact

4.2 Non-Cancellable & Non-Refundable

• Custom, commissioned, or made-to-order pieces cannot be cancelled, returned, or refunded once production has commenced
• Deposits are strictly non-refundable

4.3 Client-Provided Designs

If you provide sketches, images, references, or concepts:

• You confirm you own or have rights to use them
• You indemnify 1-OPH against any third-party claims
• We are not responsible for IP disputes arising from client-supplied designs

5. PRICING, PAYMENTS & TAXES

5.1 Pricing

• All prices are quoted in AED unless stated otherwise
• Prices may change without prior notice
• Quotes are valid only for the period stated

5.2 Payments

• Orders require advance payment or staged payments as agreed
• Production does not begin until payment is confirmed
• Late payments may delay timelines

5.3 Taxes & Duties

VAT, customs duties, import taxes, and local charges are the responsibility of the client unless explicitly stated otherwise

• International clients are responsible for compliance with local import laws

6. SHIPPING, DELIVERY & INSTALLATION

6.1 Risk Transfer

• Ownership and risk transfer to the client upon dispatch unless otherwise agreed
• Delays caused by customs, force majeure, or carriers are beyond our control

6.2 Damage Claims

• All deliveries must be inspected upon receipt
• Damage claims must be reported within 48 hours with photographic evidence
• Failure to do so voids any claim

6.3 Installation

• Installation services are provided where agreed
• Site readiness (access, flooring, power, water, permits) is the client’s responsibility
• We are not liable for site-related delays or constraints

7. RETURNS & REFUNDS

• Custom and commissioned works are non-returnable
• Retail items may only be returned if damaged or incorrect
• Refunds, if approved, are processed after inspection
• Shipping and handling costs are non-refundable

8. INTELLECTUAL PROPERTY (VERY IMPORTANT)

8.1 Ownership

All designs, drawings, renders, prototypes, models, photographs, and concepts created by 1-OPH are:

• The exclusive intellectual property of 1-OPH
• Protected under UAE and international IP laws

8.2 Usage Restrictions

You may not:

• Reproduce, modify, resell, or fabricate designs without written permission
• Share designs with third-party fabricators or vendors
• Use our designs for commercial production elsewhere

8.3 Portfolio Rights

1-OPH reserves the right to:

• Photograph and document completed works
• Use them for marketing, portfolio, website, and social media

9. WEBSITE USE & DIGITAL CONTENT

You agree not to:

• Copy or scrape website content
• Misuse contact forms or pricing tools
• Upload harmful or unlawful material
• Attempt to breach website security

We reserve the right to suspend access without notice.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• 1-OPH shall not be liable for indirect, incidental, or consequential damages
• Liability is limited to the value of the product or service supplied
• We are not responsible for misuse, improper installation, or lack of maintenance

11. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond reasonable control, including but not limited to:

• Natural disasters
• Supply chain disruptions
• Government restrictions
• Acts of war, strikes, or pandemics

12. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the United Arab Emirates.

• Jurisdiction: Courts of Dubai, UAE
• International clients agree to UAE jurisdiction regardless of location

13. AMENDMENTS

We reserve the right to update or modify these Terms at any time without prior notice.

Continued use of our services constitutes acceptance of updated Terms.
